Lumenci Expands into Damages Expert Testimony With Two Senior Expert Hires

Lumenci, a technical consulting and patent analytics firm serving IP litigation teams worldwide, today announced the appointment of Neil Zoltowski and Adam Falconer as damages expert witnesses. The hires significantly strengthen Lumenci’s Damages Expert Testimony service line, deepening the firm’s ability to pair technical and infringement analysis with credible economic damages analysis, quantification, and testimony.

About the Experts

Neil Zoltowski brings 30 years of experience in litigation support and expert consulting and testimony on complex financial and economic disputes. Over his career, Zoltowski has advised on more than 250 matters for clients ranging from individuals to Fortune 50 companies, with a focus on the quantification of economic damages in IP disputes, including cases involving patent, trademark, and/or copyright infringement, trade secret misappropriation and licensing conflicts. He also has considerable experience in commercial litigation, which includes cases involving breach of contract, unfair competition, breach of fiduciary duty, and shareholder value disputes, among others. Zoltowski has been designated as a testifying expert in federal and state courts as well as JAMS and AAA arbitrations, appearing for both plaintiffs and defendants. His experience is concentrated in high-technology industries, such as telecom, computer hardware and software, mobile devices, Internet/e-commerce, medical devices, and semiconductors. Zoltowski is a Certified Licensing Professional (CLP) and a current member (and former Chair) of the Licensing Executives Society’s Valuation & Pricing Committee. His other credentials include the Certified Valuation Analyst (CVA), Master Analyst in Financial Forensics in IP and Business Disputes (MAFF), and Certified Patent Valuation Analyst (CPVA).

Adam Falconer brings 20 years of experience in IP consulting, intellectual property damages expert testimony, licensing valuation, technology transfer, royalty diligence and recovery, and data analytics. He joins Lumenci from Royalty Sense LLC, the boutique litigation advisory firm he founded and led as Managing Director and has advised on more than 90 litigation engagements spanning financial, economic, technology, and data analysis, including extensive work on reasonable royalties, lost profits, breach of contract, and profit disgorgement, culminating in being designated as a testifying expert in federal and state courts. He holds a Juris Doctor from Syracuse University College of Law (cum laude) and is a Certified Licensing Professional (CLP), Co-Chair of the Licensing Executives Society USA/Canada Valuation & Pricing Committee and is an award-winning instructor for the Licensing Executives Society, and a member of the AICPA Forensic and Valuation Services section. He has guest lectured on IP damages at the University of San Francisco School of Law and the University of Kansas School of Law.
